State government is not bound to pay more salary like a central university: Supreme Court

The Supreme Court has said that the directions issued by the central government are not binding on the state universities. It is recommended in nature. Based on this, registrars of state universities cannot claim higher pay scales. Giving this verdict, Justice S.K. The bench of Kaul had set aside the order of the Uttarakhand High Court directing the petitioner Sudhir Budakoti to be paid the same salary as that of the Registrar of the Central University. The bench, in its judgment, held that the law in this regard (Kalyani Mathivanan v. KV Jayaraj, 2015) is an agreement that the state governments are not bound by the directions of the central government. It may be largely binding on central universities receiving funding from the central government, but it may not be binding on state institutions.

According to the case, on December 31, 2008, the Ministry of Human Resource Development issued two letters. In which it was asked to improve the pay scale of lecturers and registrars of the university. The Uttarakhand government accepted the recommendation of a higher pay scale for the teaching faculty, but abandoned the registrar. The applicant was appointed to the post of Registrar and the salary was paid as per the rules of 2006. After being posted as assistant registrar in Kumaun University, he filed a writ petition in the high court demanding equal pay for registrar of central university. Meanwhile, the Uttarakhand government fixed his salary as per the Sixth Pay Commission on April, 2011, challenged by the petitioner and the High Court declared the application unconstitutional.

The Uttarakhand government had approached the Supreme Court against the order. The state government said that the decision to revise the salary of the lecturer, not the registrar’s salary, was a policy and the government’s decision could not be subject to judicial review. The State Government is not bound to pay the same pay as the Central Government University and at the time of appointment they were given the same pay scale as that of the State.
