A special POCSO court on April 4 sentenced a 37-year-old father to 25 years in prison for repeatedly raping his 13-year-old daughter. The accused, father of three children, lived with his mother and brother. The accused was abusing his daughter and was threatening to kill her if she told anyone about the incident. The entire trial was completed in 9 months and four days.

The incident came to light on May 4, 2021, when the victim, a Class 7 student, did not menstruate, her grandmother also testified that she kept quiet and did not speak much at home. When she (grandmother) inquired about keeping calm, the victim revealed that her father was forcibly sexually abusing her for the past one year.

The victim also told her grandmother that her father had threatened to kill and kill her if she told anyone about this. After this, the grandmother of the victim reached the Worli police station and lodged an FIR and arrested the father.

Counsel for the respondent submitted that the victim was wandering and the accused prevented her from playing and talking with the boys and as a result there were frequent fights between her and the accused. The defense also pointed out that the accused’s wife had abandoned him seven years ago and had not remarried to take care of her children and elderly mother. There was also a financial dispute between him and his mother which could have led to such a false complaint.

The court observed that the victim remained silent for a long time and suffered despite being a school going girl. He had access only to his grandmother. Medical examination has confirmed sexual abuse with the victim.

The court also observed that the victim was not required to speak and did not know who to approach when such an act was made against her. She didn’t seem to have the knowledge that she could be looked after and protected if she raised her voice.

Special Judge Bharti Kale sentenced the accused to 25 years rigorous imprisonment under the POCSO Act and a fine of Rs 20,000. In default of payment of fine, he shall undergo rigorous imprisonment for a term which may extend to six months. An amount of Rs 15,000 out of the fine will be given as compensation to the victim after the end of the appeal period.
